These Terms of Use (the “Terms”) govern your access to and use of the on-demand interpretation services and software provided by Day Translations, Inc., doing business as Day Interpreting (“Day Interpreting,” “we,” “us,” or “our”), including the customer portal at app.dayinterpreting.com, our mobile applications, our Zoom App (Day Interpreting), our Webex Embedded App (Bridge Interpreter), our toll-free IVR phone service, our Day Interpreting app inside OpenAI ChatGPT, and any future apps or integrations we publish to third-party marketplaces such as Microsoft AppSource, Google Workspace Marketplace, or the ChatGPT App Directory (collectively, the “Service”).
By creating an account, signing in, installing one of our embedded apps, or otherwise using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization, and “you” refers to both you and that organization.
1. The Service
Day Interpreting provides on-demand professional interpretation in over 230 languages by qualified human interpreters. You can access the Service through any of the following channels:
- The customer portal at app.dayinterpreting.com.
- Our toll-free phone numbers (IVR).
- The Day Interpreting Zoom App (one-click interpreter inside an active Zoom meeting).
- The Bridge Interpreter Webex Embedded App (one-click interpreter inside an active Webex meeting).
- The Day Interpreting app inside OpenAI ChatGPT, available through the ChatGPT App Directory. Inside ChatGPT you can ask us to look up languages, check your balance, view your call history, or start a callback that rings your phone and connects you to a live interpreter. Payment for new credit and new-account signup happens on our customer portal at app.dayinterpreting.com — not inside ChatGPT.
- Future integrations we publish to additional meeting platforms, AI assistants, or app marketplaces.
We may add, modify, or discontinue features at any time. Where a change materially reduces functionality you actively rely on, we will give reasonable advance notice through email or an in-portal notice.
2. Eligibility and account responsibilities
- You must be at least 18 years old and able to enter into a binding contract to use the Service.
- You must provide accurate and complete account information and keep it up to date.
- You are responsible for safeguarding your password and for any activity under your account. Notify us immediately at interpreting@daytranslations.com if you suspect unauthorized access.
- You may invite team members to your organization account; you remain responsible for their use of the Service.
3. Acceptable use
You agree NOT to use the Service:
- For any illegal, fraudulent, or abusive purpose.
- To harass, threaten, or harm interpreters or other people on the call.
- To request services that involve clearly criminal conduct.
- To reverse-engineer, copy, or scrape the Service (except as expressly permitted by applicable law).
- To attempt to gain unauthorized access to other accounts, our systems, or the meeting platforms we integrate with.
- To impersonate another person or misrepresent your identity or organization.
- To resell or sublicense the Service to a third party without our written consent.
- To circumvent billing or balance protections (for example by chargeback fraud).
We may suspend or terminate accounts that violate these rules, with or without notice depending on the severity of the violation.
4. Pricing, billing, and refunds
4.1 Per-minute pricing
Interpretation calls are billed per minute at the rate applicable to the language pair you selected, plus any applicable surcharges (for example a meeting-bridge fee when an interpreter is dialed into your Zoom or Webex meeting). The full per-minute rate is shown in the portal before you start a call. Calls are subject to a two-minute minimum once both parties connect; if the call never connects there is no charge.
4.2 Prepaid accounts
Prepaid customers fund a credit balance via card payment (processed by Stripe). Each call deducts from your balance in real time. You can configure auto-recharge from the Settings page.
4.3 Postpaid accounts (NET terms)
Eligible business customers may apply for NET-15 or NET-30 terms. Approved postpaid customers receive monthly or per-call invoices and are charged against an agreed credit limit. Outstanding invoices not paid by the due date may result in service suspension and may accrue interest at the lesser of 1.5% per month or the maximum allowed by law.
4.4 Taxes
Prices do not include taxes. You are responsible for any sales, use, value-added, or similar taxes assessed on your purchase (other than taxes on our net income).
4.5 Refunds
We will issue a refund for a call that fails to connect or that is materially impaired by a defect on our side. Refund requests for completed calls are considered case-by-case. To submit a refund request, use the Refund Request form in the portal or email interpreting@daytranslations.com.
5. Third-party platform and AI-assistant integrations
When you use Day Interpreting through a meeting platform such as Zoom, Cisco Webex, Microsoft Teams, or Google Meet, or through an AI-assistant integration such as our Day Interpreting app inside OpenAI ChatGPT, you also agree to comply with that platform's terms of service. We are not responsible for outages, content moderation decisions, or actions taken by those platforms.
You may uninstall or disconnect any of these integrations at any time. Instructions for the Zoom App are available in our help center. The Day Interpreting app inside ChatGPT can be disconnected from ChatGPT Settings → Connectors. Uninstalling or disconnecting an integration revokes its access to that platform but does not close your Day Interpreting customer account.
6. Interpreter conduct and confidentiality
All interpreters who serve your calls are bound by professional confidentiality obligations. Interpreters provide linguistic interpretation only and do not provide legal, medical, financial, or other professional advice. You remain solely responsible for decisions and actions you take based on the content of an interpreted call.
If you record a call, you must comply with all applicable recording, wiretap, and two-party-consent laws and must inform all participants at the start of the recording.
7. Privacy
Our handling of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
8. Intellectual property
The Service, including its software, design, text, graphics, logos, and trademarks, is owned by Day Translations, Inc. or its licensors and is protected by U.S. and international intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes.
Feedback you submit to us about the Service is non-confidential and we may use it without restriction.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, DAY TRANSLATIONS, INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE INTERPRETATION PROVIDED WILL BE FREE OF MISTAKES.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL DAY TRANSLATIONS, INC. OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST REVENUE, OR LOSS OF DATA) ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the foregoing limitations apply only to the maximum extent permitted by applicable law.
11. Indemnification
You agree to indemnify and hold harmless Day Translations, Inc., its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) your access to or use of the Service, (b) your violation of these Terms, (c) your violation of any third-party right, including any intellectual-property right or privacy right, or (d) your violation of any applicable law.
12. Termination
You may close your account at any time by contacting support. Outstanding balances or invoices remain due. We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or if continuing to provide the Service to you would be commercially impractical. Sections that by their nature should survive termination (including sections 4 through 14) will survive.
13. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in New York County, New York, and the parties consent to the personal jurisdiction of those courts. The U.N. Convention on Contracts for the International Sale of Goods does not apply.
14. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will post the updated Terms at this URL with a new effective date and, where appropriate, notify you by email or through a notice in the portal at least thirty (30) days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
